广告语著作权侵权行为界定研究

摘    要:广告语如果具有独创性,可能被认定为著作权法保护的客体。广告语著作权侵权行为成立是认定侵权者是否承担侵权责任的前提,可采用实质性相似、接触、排除合理的怀疑法,思想表达二分法,抽象、过滤、比较法等方法对其作出界定。

Abstract:If the advertisement words have originality, they can be regarded as the objeet protected by Copyright Law. Tort of advertisement words copyright is the premise that the party should take the responsibility, So we can use the following ways to bound the tort, such as doubt of similar substantiality anti reasonable exclusion; dichotomy of expreSSing thought metaphysical and fiherable Comparison, and etc.
