| 摘 要： | 该文指出，将环境容量作为一种资源进行管理，在一定的环境目标条件下，利用市场经济的手段实现环境资源的优化配置，是排污权交易理论的核心所在。在总量控制的前提下实行排污权交易首先涉及排污权的初始分配问题。在国内现有的条件下，付费取得初始排污权具有正当性。在实际的排污初始分配中，可以采用免费分配和有偿分配相结合的模式，以兼顾各方的利益。 |

| Abstract: | The core of the emission trading theory is to manage the environmental capacity as a sort of resource and employ the approaches of market economy to optimize the allocation of environmental resources under the certain environmental target. The implementation of controlled emission trading involves the initial allocation of emission fights in the first place. The paid initial allocation of emission fights is relative and conditioned, which has the legitimacy in contemporary China. |
