行政诉讼证明标准之重构

我国现行法律中关于行政诉讼证明标准的规定诟病多多，重构我国行政诉讼证明标准体系实为必要。重构行政诉讼证明标准应考虑行政行为的多元化、诉讼成本、诉讼模式等因素。同时合理借鉴域外成熟经验，并将自由心证明纳入法律调控和监督之下，构建行政诉讼多元化证明标准体系。

Meanwhile, it is necessary to learn from the experience of other countries and discretional evaluation of evidence in constructing multi - criterion system of proof in administrative litigation.
