中国宪法应如何设置人权

基于中国的人权实践 ,对比两国际人权公约与中国宪法 ,中国宪法对人权保护的空间有待大大拓展 ,人权入宪应为新一轮修宪的最主要议题之一。设置人权有四类七种选择方案 ,宪法人权一般条款 +法律设置当是目前中国设置人权的可行模式。就修宪而言 ,应在宪法序言和总纲中分别加上人权一般条款 ,内容分别为 :尊重和保护人权 ,促进实现人权 ;国家权力受人权直接约束。

How to Establish Human Right in the Constitution

On the basis of the practice of human right, and the comparison between international convention of human rights and the Constitution of China, the Constitution of China needs to be further broadened in the aspect of human right protection. Incorporating human right in the Constitution shall be a main topic in the new modification of the Constitution. Establishing the human rights has four categories and seven kinds of options. The general item of constitutional right and the setting of law are a operative mode to set up human rights in China. As to the modification of the Constitution, the general item of human rights shall be added into the preliminary remarks and the general program. The content of it shall include respecting and protecting human right, promoting the realization of human rights, and state power being directly bounded by human rights.
