| 摘 要： | 烟草专卖是国家通过制定法律 ,对烟草买卖实行垄断 ,以保证财政收入。《烟草专卖法》和《价格法》是同一位阶的普通法 ,以特别法优于普通法、后法优于前法的理由 ,主张将烟草价格推向市场 ,是不能成立的。这一问题还涉及法律解释的权限、法律解释的效力问题 ,亟需认真研究和对待。

| Abstract: | Monopolization of tobacco means the State monopolizes tobacco transaction by making the law to guarantee the financial income. The Law of Tobacco Monopolization and The Law of Price are ordinary laws. It is not reasonable to make the prices of tobaccos be regulated by market on the ground that special laws are prior to ordinary laws and subsequently-made laws are prior to the previously-made laws. This issue also involves the scope of authority of the legal interpretation, and the effectiveness of the legal interpretation, which needs to be closely studies and considered. |
