鉴定人的法律责任是司法鉴定制度的一个重要的组成部分。从比较法角度分析在英美法国家和大陆法国家鉴定人法律地位的两种基本样式及其特征 ,比较不同程序结构下鉴定人承担的法律义务和相应责任的性质及内容 ,从而对我国鉴定人责任机制进行宏观建构。

On Legal Status and Its Legal Liability System of Expert Witness

The legal liability of expert witness is an important part of expert testimony system. Firstly, from the perspective of comparative law this article analyses two basic patterns and their characteristics of legal status of expert witness in Anglo-American law system countries and continental law system countries. Secondly, on the basis of the above-mentioned , this article compares the nature and content of legal obligation and relevant liability of expert witness under different procedural structures . Lastly, on the basis of China's current condition and orientation of legal status of expert witness, this article preliminarily constructs the nature, type and component part of legal liability of expert witness in expert testimony .
