论沉默权制度及其在我国的确立与保障

中国目前已签署加入了《公民权利和政治权利国际公约》等有关刑事被告人人权保护的国际公约 ,意味着中国已承诺并承担了保障这些公约中所确立的被告人最低限度人权之义务。但是作为这些基本权利中最重要的内容之一的沉默权 ,在我国刑事诉讼中尚未明确规定。沉默权制度经过长期的发展 ,已成为现代国际刑事诉讼主要价值取向和重要内容。我国应当确立有限沉默权制度

On the System of Right to Silence and the Establishment and Guarantee thereof in China

At present China has signed and entered into some international conventions concerning criminal defendants' human rights such as International Covenant on Civil and Political Rights.This means China has promised and assumed the obligation of guaranteeing the minimum human rights of defendants established in the conventions.However,as one of the most important content of the basic rights,the right to silence has not been prescribed in the criminal proceedings in China.After a long period of development,the right to silence has become the primary value orientation and important content of modern international criminal proceedings.The limited system of right to silence shall be established in China.
