试论减刑程序的改革与完善

减刑是我国一项重要的刑罚制度,在矫正犯罪和鼓励犯罪人自新方面发挥着不可替代的作用。然而,我国现有的减刑制度远未成熟,特别是在减刑的适用程序方面仍存在诸多疏漏。因此,有必要从权力配置、程序参与人、程序形式、救济机制和监督机制五个方面对其进行改革与完善。

On the Reform and Improvement of the Procedure of Commutation

Commutation is an important system of punishment in our country,which plays an irreplaceable role in correcting crimes and encouraging criminals to reform.However,our country s current commutation system is far immature,especially there are many omissions in the application procedure of commutation.Therefore,it s necessary to reform and perfect it from such five aspects as collocation of power,procedural participants,procedural forms,relief and supervision mechanism.
