| 摘 要： | 我们首先必须承认片面共犯的现实存在是不容置疑的。在理论界,对片面共犯的定性存在着争议,或认为其为共同犯罪的一种特殊类型,或认为可以将其视为间接正犯加以处理。笔者认为,片面共犯不是特殊的共同犯罪也不能等同于间接正犯,它是一种特殊的犯罪形态。

| Abstract: | The existence of the unilateral accomplice is out of the question.In the theory circle,there is argument on the concept of the unilateral accomplice,one point think it is a special type of the accomplice,the other point think it should be looked upon as indirect guilt.this paper think it is neither a special accomplice,nor indirect guilt,but a kind of special crime. |
