| 摘 要： | 律师在场权制度的模式大致可分为实质在场和形式在场两种类型.尽管由于立法理念和司法实践的差异,各国对于律师在场权制度的具体规定有所不同,但都将其落实在侦查阶段.律师在场权制度在我国的确立具有丰富我国刑事诉讼基本理论和保障犯罪嫌疑人基本人权的理论和实践功能,确立该制度对于实现刑事诉讼的目的有着重要的理论和现实意义.但在中国一步到位地建立该制度,无论从理念转换还是制度设计上来看都是非常困难的.鉴于律师在场权在侦查讯问时的积极作用和在整个刑事诉讼中的制度性功能,在未来的刑事诉讼法典再修改过程中应有步骤地建立这一制度,并通过立法技术等手段来克服实践中有可能出现的问题.

| Abstract: | The countries set down the different provisions on the right of lawyer's presence resulted from the discrepancy concerned the legislative concept and judicial practice.However,the provisions are conducted in the investigation.Though the right of lawyer's presence can realize the purpose of criminal Law,it is greatly difficult to contrive this system in one action both from conceptual and practical angles.Considering the positive function of the lawyer in the investigation and the whole criminal process,the right of lawyer's presence shall be set up step by step in the modification of Criminal Law.Any other technical legislative measures shall be taken so as to overcome the possible problems. |
