| 摘 要： | 司法实践中证人拒不出庭作证、作伪证等现象普遍存在。证人拒绝作证的原因主要有 :法律规定的证人保护制度不完善 ,未能形成对证人权利或权益的有效保护机制。我国应在立法上消除对证人范围的限制 ,赋予证人拒绝作证权。
