| 摘 要： | 在当今中国,陪审制度不仅具有重要的政治意蕴与司法功能,而且对于深化司法体制改革以实现审判独立与完善刑事审判程序具有独特的技术功能。只有科学设置陪审制度,上述功能才能得以实现。《关于完善人民陪审员制度的决定》的制定,是对我国陪审制度的重大发展,不过规定仍显简略,且其中的一些条款与陪审制度的本质和规律不尽契合,抑制了陪审功能的发挥。应对我国陪审制度进行实质化改造,保障其功能的充分实现。
