| 摘 要： | 随着人类文明的发展 ,保护人权废除死刑是国际立法的主流 ,我国的死刑立法相对来说不容乐观 ,死刑罪名居高不下 ,尤其是经济犯罪适用死刑偏高。抑制犯罪并非仅靠死刑的威慑 ,而靠社会全面发展。我们已加入《公民权利和政治权利公约》 ,应当走先限制后废除的道路 ,以与国际立法逐步接轨。

| Abstract: | With the development of the civilization,protecting human rights and abrogating capital punishment is the main current in international legislation.Our legislation situation allows of no optimism.There are too many criminals sentenced to death, especially economic ones.To control crime can not depend on the deterrence of death penalty,but on the full development of the society.We have joint "Citizen Rights and Political Rights Convention",we should limit the application of capital punishment according to our national conditions. |
