赠与合同信赖利益保护探究

国合同法赋予了赠与合同中的赠与人享有对赠与的任意撤销权和法定撤销权，以此来衡平因赠与合同的单务性而给赠与人带来的不利影响。但是，任意撤销权制度的存在又为赠与人滥用权利损害受赠人信赖利益留下了隐患。赠与合同有单务性、诺成性的特点，任意撤销权制度有缺陷，应完善对我国赠与合同信赖利益保护的立法。

A Study on the Protection of Reliance Interest in the Contract of Gift

In order to balance the unfavorable effects caused by the unilateral nature of the contract of gift, China＇s Contract Law has endowed the donor with the statutory and arbitrary rights of revocation. However, the existence of the arbitrary right of revocation is a hidden danger to the donee because of the donor may abuse his right. Based on the unilateral nature and the promissory nature of the contract of gift, this article analyzes the purposes and defects of the arbitrary revocation right system and appraises the existing various viewpoints, and then puts forward its own opinions with the hope to perfect the relevant legislation.
