| 摘 要： | “马锡五审判方式”的精髓是司法便民，它是适应我国陕甘宁边区司法实践环境的审判方式。当前重彰“马锡五审判方式”具有重大的现实可能性和意义。“马锡五审判方式”与现代诉讼制度并不是对立的，程序化实现、发展“马锡五审判方式”中的“便民”精神不会扼杀其灵活多样、方便群众的优点。
