从自由与秩序的辩证关系看法制现代化的价值基础

关于自由与秩序的理论源远流长,两种理论自产生时起,相互之间即充满张力。人的自然本性与非理性特征倾向自由,而人的社会本性及理性特质则偏好秩序。但自由和秩序并不是超越历史的概念,自由存在于法律秩序之中,法律秩序的目的在于保障自由,人类生活的理想模式是自由与秩序的合谐和统一。在现代法律的价值体系中,自由是目标性价值,秩序是基础性价值,两者是目的与手段的关系。

On Value Foundation of Modernization of Legal System from Perspective of Relationship between Freedom and Order

Theories of freedom and order was of long standing,which have been in interaction since the day they came into being.Human beings tend to be liberal instinctively and non-rationally,whereas he prefers order in respect to social nature and rational character.However,they are never separated from each other in that freedom is embodied in legal order while the latter aims to keep the former.In modern legal value system,freedom is the target value,the target,while order is the fundamental value,the means.
