普通法系财产权转让的信用保障——不动产法的登记制度

摘    要:不动产财产权的转让是市场经济的重要内容 ,其信用体系之保障向为各国法律所关注。普通法系的不动产登记制度是英美国家确保本国不动产财产权转让信用秩序的重要制度。普通法系的登记法有四种类型 :通知型、登记优先型、登记优先 -通知型和宽限期型。进行了登记的不动产契据对不特定第三人具有优先效力 ,按照推定通知规则 ,只有履行了查询义务的买受人才能成为善意买受人受到登记法的保护。

Abstract:The real property conveyancing is an important part of market economy. The credit assurance system of real property conveyancing is a focus subject of law. The real property recording system of common law system is a key institute that common law countries count on for protecting real property conveyancing's credit order. The recording system of common law system including four types the notice, the race, the race-notice, and the period of grace. The recorded deeds have priority to the unrecorded. The principle of constructive notice provides only when a buyer performed inquiry duty can be the bona fide purchaser and protected by recording system.
