| 摘 要： | 《国家赔偿法》在程序方面的修改主要有增设协商程序、赋予当事人一定的程序权利、细化期限的规定、取消确认违法的程序、完善人民法院赔偿委员会的决定程序。上述修正使《国家赔偿法》更接近程序正义,但先行处理程序违反自然正义,协商程序缺乏可操作性,确认与赔偿程序合并是否科学仍有待实践检验。完善国家赔偿程序,应遵守公正原则、公开原则、参与原则和效率原则,未来可考虑出台专门的《国家赔偿程序法》。
