| 摘 要： | 现有的文化财产国际争议解决机制并非总是令人满意。以有关国际公约为基础,建立专门的文化财产国际争议仲裁庭,应是解决文化财产国际争议的另一有益尝试。文化财产国际争议仲裁庭可以充分发挥仲裁解决国际争议的优势,并在借鉴已有的国际争议仲裁机构成功实践的基础之上,通过构建自身的程序规则为文化财产国际争议找到令人满意的解决方案。

| Abstract: | The legal regimes available for resolving international disputes over cultural property are less than satisfying. To establish a specialized international arbitral body, based on relevant international convention, is an effective alternative. Such an international arbitral body will on the one hand, give full play to the role arbitration plays in resolving disputes, and on the other hand, drawing lessons from the practices of existing arbitral tribunals, construct its own procedure rules in an effort to find a solution that meets the needs of both parties. |
