| 摘 要： | 加重犯是在基本刑以外由刑法规定更重的法定刑的犯罪形态.它由加重基础和加重因素两部分构成.现行刑法理论对加重基础类型的认识过于狭隘.加重基础除基本罪以外,还应当包括加重犯和非犯罪的事实状态.

| Abstract: | The aggravated offense is a criminal state with more aggravate penalty than basic one. It consists of the basic of aggravated offense and the condition of aggravated offense. The view of present theory of criminal law to aggravate basic is over narrow. The aggravate basic should include aggravated offense and the fact states of non-crime besides essential offense. |
