| 摘 要： | 环境问题的复杂性、代际性、多元性以及环境行政决策所具有的科技关联性和利益冲突性等特点，印证了对于政府及其部门的环境行政决策行为法律规制的必要性。然而此种法律规制不是消极的控权，而是在环境行政决策中增加对公众环境权益的考量以及符合相关技术标准后所谓的综合决策机制，同时考虑激励机制。

| Abstract: | Nowadays, complexity, intergeneration and diversity are the features of environmen- tal issues. Technology complication and conflict of interest are the features of the administrative de- cision-making environment. These proved that the executive decision of environmental problems had to be restricted by law is necessary. However, this kind of restriction of law is not the negative regu- lation of right, but the institution of integrative decision making that increase the respect of the pub- lie environmental benefit and the accords of technical standard which are related. At the same time, this kind of regulation of law also considers the institution of encouragement. |
