| 摘 要： | 本文在运用“解构”方法对行政法本质的传统研究范式之弊端进行剖析的基础上 ,指出科学认识其本质的途径在于转换研究范式 :以“相对论”的视野在运动、变化、发展中 ,将行政法的基本矛盾双方 ,置于不同参照系下进行考察 ,从而得出行政法的本质具有相对性 ,动态性和开放性的特征 ,存在于确定性与非确定性、运动与静止、应然与实然的统一过程中。
