论行政重复处理行为——以"程序的重新进行"为基准

行政重复处理行为渊源于德国的重复处置的概念,随后被我国台湾地区引入.目前学界对行政重复处理行为理解不一.学界通说把行政重复处理行为的性质定位为行政事实行为,以已经有效的行政行为为前提,是依申请的行为,不具可诉性,对行政法律关系主体不产生新的法律效果.但是,行政重复处理行为并不应仅限于行政机关"驳回当事人对行政行为提起申诉"的行政行为,作为具有我国特色的权利救济制度--信访制度,信访机关在行政行为正式法律途径救济之后作出的重申原行政行为的处理决定也应属于此列.

On Administrative Repeated Disposal Action——On the basic of renewing the procedure

Administrative repeated disposal action which origins from Germany's re-disposal concept,introduced by Taiwan district of our country afterwards.At present,there are different comprehensions of administrative repeated disposal action in academic circles.The academic circles popularly think that its nature is the administrative fact behavior,taking the effective administrative action as a premise,an applicative behavior,and does not sue,not produce the new legal results to the administrative legal relationship parties.But,the administrative repeated disposal action should not only be restricted in the administrative department to reject the administrative action that the litigant appealed to the administrative action.Letters and call system is a characteristic of our right relief system,the appeal department's administrative decision to reiterate the original administrative action also should belong to this scope,as the administrative action relieved from the official law way.
