农户承包集体土地合同上的财产关系

Property Relations in Contracts for Farmer Household＇ s Contracted Management of Collectively -owned Land

Various issues over collectively owned land are hot topics in study of law, in which the contract for farmer household＇ contracted management of collectively - owned land is a new type of contracts. The na- ture of the contract and the property right obtained therefrom should be regulated by the Civil Law and the pro- tection mechanism and detailed rules should be set up therefore. It is suggested to analyze the historic evolu- tion of the contract for farmer household＇ s contracted collectively - owned land with regard to the fundamental legal relationship, the nature of property rights obtained based on the contract and the subjects of the property rights. The key to the issue lies in the uniform principles and norms on integrated application of such contracts.
