| 摘 要： | 对交通肇事行为的责任判断,道路交通行政管理部门立足于交通秩序的整体状态,而刑事司法部门则重点立足于因果关系,这两种判断标准的不同会带来许多的负面影响,因而应将交通肇事行为的责任判断标准统一起来,采用道路交通管理部门的判断标准。

| Abstract: | When judging the liabilitiy of causing traffic trouble, administrative authority for traffic lays stress on the whole traffic order, while criminal judicial department attaches importance to the causation. The different criteria will undoubtedly cause some negative influences. Therefore, we should unify criteria of liability judgment in causing traffic trouble and adopt the criterion of administrative authority for traffic. |
