论服务消费与我国消费者权益保护法的完善

摘    要:服务消费近年来随着经济的发展而迅猛发展,而服务消费中存在的诸多消费者权益得不到保护的现象也不断出现,逐渐上升。针对我国服务消费中消费者权益受损害的实际状况,分析了服务消费类型、问题及原因,指出了服务消费法制的欠缺,对服务消费权益保护从法理上作了初步分析,提出了完善《消费者权益保护法》与服务消费管理条例的立法建议。

Abstract:The service consumption developes swiftly and violently along with the growing of the economy,while the phenomena that the consumers'rights and interest can't be protected come forth and go up.This paper aiming at the factual status of the consumer's rights and interest be damaged in service consumption,analyses the types,problems,causes of it,points out the jural deficiencies,elementarily analyses the protecting of it in nomology,puts forward the legislative suggestions on perfecting the law protecting the consumer's rights and interest of China and the administrative byelaws on service consumption.
