十字路口的中国司法改革:反思与前瞻

在学界倡导、实务界推动与官方决策的共同作用下,中国十多年的司法改革取得了突出成就,呈现出学术话语鼓动与牵引、实务界跟进与展开、中央决策指导与把关的基本面相。总结与回顾改革的历程,中国的司法改革存在诸如司法公正有待提升、司法效益有待提高与诉讼成本有待降低等现实难题,这与应然改革主体缺位、改革理想偏失以及改革条件匮乏等有关。中国未来的司法改革首先应让应然的改革主体归位,并在合理确定改革理想的基础上,采取本土意识上的建构与试错路径来推进。
