| 摘 要： | 婚姻关系中忠实义务不是从来就有 ,而是随着社会生产力发展和人类文明程度不断提高过程中产生 ,是人类理性的体现 ,诚实信用原则在婚姻关系中 (特别是夫妻关系 )中概括性的体现。忠实义务既是一个道德问题 ,也是一个法律问题 ,因为基于婚姻关系既是伦理的共同体 ,又是法律上的共同体这一双重属性所致。但是必须提出 ,忠实义务既不是“从一而终” ,也不是双方的“卖身契”。忠实义务是夫妻双方平等所负的义务、责任 ,违反忠实义务 ,就会承担相应的民事责任。

| Abstract: | The responsibility of loyalty reflects both the Human's logos andthe principle of good faith. It is both a problem concerning the morality and a problem concerning laws. But it means neither "from the very beginning to the end" nor a contract of selling oneself. The responsibility of loyalty is a equal responsibility for both the spouses. |
