论农民权益的经济法保护——以利益与利益机制为视角

中国“三农”问题的关键是农民问题,农民问题的核心问题是农民利益问题。农民利益需要宪法、经济法、行政法等诸多法律部门共同深护,特别需要经济法律制度提供支撑。本文以利益与利益机制为视角,在探寻经济法与农民权益保护的结合点、寻找经济法保护农民权益理论基础的基础上,提出了经济法视野下保护农民权益的机制体系,归结了经济法保护农民权益的基本原则,构想了一整套保护农民权益的经济法制度体系。

The Peasant problem is the most fundamental among "Rural Area Problem. Agricultural Problem and Peasant Problem" in China. The right and interest problem is the core problem of peasant . It needs the common protection from legal departments such as constitution law. Economic law and Administrative Law, especially the support of Economic legal system. In the article, from the perspective of profit and interest and profit and interest system, on the basis of exploring the theory of profit and interest and profit and interest system, the author analyzes peasant's right and interest protecting system from the perspective of economic Law, and proposes the basic principles of protecting peasant's right and interest from economic Law's perspective, and concludes the economic legal system of protecting peasant's right and interest.
