广告违法与公益诉讼

区别于传统违法行为受害人特定的特点，广告违法行为的受害人往往具有不确定性和扩散性，更多的侵害了公共利益。在现行诉讼模式中，刑事诉讼着重对刑事犯罪的处罚，民事诉讼着重特定诉讼主体民事权益的司法救济，行政诉讼着重对特定行政相对人权益的保护，因此，现行三大诉讼均在公共利益的保护层面上存在缺陷。公益诉讼以公共利益保护为目的，既可以由国家授权的检察机关或政府机关代表国家提起诉讼，也可以由公民或社会组织以自己的名义提起诉讼，扩大了司法程序中原告资格和受案范围以及诉讼请求，为公共利益保护提供了合理有效的制度保障。

Advertisement Illegality and Public Interest Litigation

The injured party in advertisement illegality is indefinite and undefined,that is different from traditional illegality.That means advertisement illegality ruins the public interest more seriously.In the current litigation patterns,the criminal prosecution puts the focus on the punishment of criminal offense,while the civil action pays more attention on interest compensation of definite injured party,administrative proceedings requires the prosecutor on flip side of an administrative action.In this way,current three litigation patterns are not perfect on the protection of public interest.Public interest litigation,which aiming on protecting public interest,can be sued in the name of the nation by the prosecutor's office or by the department of government.Both of their powers are authorized by the nation.Meanwhile,Citizens and social organizations can also sue in the name of their own.Public interest litigation enlarges the qualification of prosecutors,broadens the scope of the cases on file for prosecution and expands the motions,which provides available and effective litigation pattern for public interest protection.
