可持续发展背景下的循环经济法律问题研究

在可持续发展理念的指导下,循环经济这种全新的经济模式显得越来越重要.2006年《循环经济法》(草案)已经初现轮廓,但是客观地讲我国从引入循环经济至今还没有建立完善的法律制度来规制和指导它的运行.在分析研究现有循环经济法律制度的基础上,我国对不适应新环境的法律规范应当及时调整、修订;在法律制定之外,应当确立贯穿法律体系的循环经济法律理念;此外,除了生产者责任之外,对消费者责任也应当予以重视.

Legal Study on Circular Economy under the Sustainable Development Background

Under the instruction of view of sustainable development, the entirely new mode of circular economy plays a more and more important role. In 2006, the "circular economy law" (draft) had became an embryonic form. But objectively, our country does not have an adequate legislative system to regulate and direct its movement now. On the analysis of existed legislative system of circular economy, legal rules which are not fit for new environment should be revised in time. The idea of circular economy should be established through the legal system besides the legislation. In addition, both the consumer's responsibility and producer's responsibility should be paid attention to.
