基于派出所法律实施的基层社会治理法治化——以浙江K派出所为例

改革开放三十多年来,"严打"、"普法"、"社会治安综合治理"以及"社会管理综合治理"等方式可以看作是国家对基层社会进行治理的探索.十八届四中全会提出"推进基层治理法治化"吹响了全面依法治理基层社会的号角.作为拥有执法人员数量最多的基层执法机构,处在社会矛盾解决第一线的派出所的法律实施依据、方法和技术理应为基层社会治理提供法治资源和法治路径.浙江省K派出所的案例、做法和制度有力地诠释了派出所的法律实施契合基层社会治理.派出所法律实施所展现出来的四大法治功能是推进基层社会治理法治化的桥梁.派出所应从人口管理、行政执法、刑事司法、服务社会、走群众路线、严格遵守程序原则和善于运用非正式制度性因素等方面来为基层社会治理法治化提供理念支持和行动榜样.

Under the Rule of Law in Grass-root Social Governance Based on the Legal Enforcement of Police Stations-A Case Study of Zhejiang K Police Station

For more than 30 years from the Reform and Opening-up,China has explored many methods in managing grass-root social governance which include strike-hard campaign,legal education,comprehensive management of public security,comprehensive management of social management and so on.The formulation,Promote the governance under the rule of law in grass-root society,in the Fourth Plenary Session of the Eighteenth National Congress of the Communist Party of China strengthened the above and sounded the clarion call for comprehensive governance of grassroots society.In China,police station is the most widespread and powerful law enforcement agency to solve social conflicts,therefore,its legal basis,methods and techniques should be the resources and guidance for grass-root society administration.The case studies,practice and system of Zhejiang K Police Station is a powerful interpretation of the implementation of law enforcement of the police station grassroots social governance.The four functions of the rule of law in the law enforcement of police station are the bridge to promote it at the grassroots level through the implementation of the law of the police station.The police station should provide legal theory support and be the model for grassroots social governance from aspects of population management,administrative law enforcement and criminal justice,social services,follow the mass line,strictly abide by the rules of procedure and the good use of informal institutional factors and so on.
