| 摘 要： | 本文以经济学中的价格市场理论和外部性理论为工具，从预防角度考察民事责任（以损害赔偿为主）的社会功能，并指出为达到最佳预防目的，在两种不同的情况下，致害人应负损害赔偿数额的原理与计算方法。

| Abstract: | The article aims at deliberating the social objective of the civil liability. We argue that with respect to the general deterrence, a wrongdoer must recompensate the compensatory damages which is equal to the ho caused by his activity when the harm is found, and must compensate the punitive damages equal to the amount that the ho multiples the reciprocal of the probability of being found when be has the chance of escaping liability. |
