| 摘 要： | 诉讼公正与诉讼效率是刑事诉讼法学中许多重要的理论与实践问题的最终归结点 ,诉讼公正与诉讼效率两者在宏观上是统一的 ,但是 ,两者之间常常存在尖锐的矛盾。因此 ,当两者发生矛盾时 ,应当如何取舍 ,如何在二者之间寻求一种平衡 ,是一个值得深思的问题。本人认为 ,应该以公正为重 ,兼顾效率。
