法律是行为的规范之再思考——从法律基本特征理论的革新谈起

法律基本特征理论对于一国法学和法制的发展影响深远。当前我国的法律基本特征理论还未摆脱传统“王法”解释的思路,与中国法治社会的发展目标很不适应。为此必须予以重新定位,建立起一套体现时代精神的、符合中国市场经济法治社会发展方向的新的法律特征说。现代法律作为行为规范所包含的三层含义:法律只针对行为而不问主体、不干涉思想、不规定结果,这些判断、结论在当今的中国具有现实意义。

Rethinking about Law as Behavior Norms

The basic characteristic theory of jurisprudence exerts a tremendous influence on national legal science and legal system.Now the views of the basic characteristic theory of jurisprudence in China have been still sticking to the old way that can be inconsistent with development end of Chinese society on the rule of law.So,a new theory of basic characteristics theory of jurisprudence should be set up which is consistent with the progress trends of socialist market economy and the society on the rule of law in China.Modern law as behavior norms has three meanings:law only to objective behavior not to subject or thought and result.These judges and conclusions have a practical significance in present China.We should understand correctly the nature and sense of the rule of socialism law and found n jurisprudence with the idea of the rule of law by which guide a harmonious society.
