Economic Analysis of Inventive Step of Patent

In the economics literature, there are four main approaches to the nonobviousness requirement for patentability: option value, sequential innovation, error-cost, and complementary innovation. These economic theories offer a useful perspective on the understanding of inventive step in patent, and can be helpful in the formulation of patent policy and assessment of inventive step of patent in judicial practice. The analysis in this article show that many of the rules of patent examination and patent trial are in line with economic rationality. To provide specific guidance for policy-making and inventive step judgment, further research of economic analysis is needed, because economic theory is enable to provide the operable tools.
