| 摘 要： | 村民自治是一种权利自治,村民自治主体是自治权的享有主体,区别于村民自治法律关系主体。村民自治主体应当是作为个体的村民,而村民集体和村民委员会都不是自治的主体。在界定作为自治主体的村民时,除了有户籍和居所都在本村的以外,还有外来人员和外出人员两种特殊情况,在一定范围内,他们也可以成力自治主体。"户"作为一个特殊村民自治主体而存在,有其一定的积极意义。

| Abstract: | Villager autonomy is a special autonomy of China. The subject of villager autonomy is the subject of the right of autonomy. It is different from the subject of autonomy legal relationship. Individual villager, not villager committee and village ,is the subject of autonomy. Registered permanent residence and residence in fact are two standards to define the villager. Someone who just inhabit in the village but did not register permanent residence in the village could be the subject of autonomy in some scope. It is useful to let family be a special subject of autonomy for a long time. |
