媒体监督与司法独立的法理分析

司法独立是法治国家的要求,又是实现司法公正的保障。在实践中,人们对司法公正的期待日益迫切,对作为公权力的司法权的腐败尤为关注。司法权需要监督,但监督要有一个度。由于我国缺乏对媒体的规范,媒体在行使监督权过程中干预了司法,影响了司法独立,产生了媒体监督与司法独立的冲突。要解决这一冲突必须了解冲突产生的背景及原因,找出解决冲突的合适的方法,从而将媒体监督与司法独立之间的冲突转化为良性互动。

The Theoretical Analysis on the Conflict of Medium Inspection and Judicatory Independence

The judicial independence is a request of nation of rule of law,and it is a guarantee for the realization of the judicatory fairness.In the practice,people anticipate judicatory fairness increasingly and urgently.The corruption of judicature draws much attention particularly.The judicature demand inspection,but it has a degree.Because of lack of the medium's norm in our country and the interference of medium into judicature,the judicatory independence has been affected,the clash between medium and judicial independence has resulted.We must analyze from the legal theory angle,grasp the background and reason,which aroused the conflict,and find out the methods to solve the clashes properly so as to convert the conflict into positive interaction.
