民法的功能缺陷与经济法的弥补

本文在肯定民法在商品经济初期作用的同时,指出,随着社会经济的发展,导致经济主体平等性的丧失;所有权绝对受到限制;契约从自由转变为相对自由;组织因素出现。这使得传统民法在调节上产生缺陷。笔者认为由一个新的法律部门———经济法来弥补这种功能缺陷成为历史必然。

Functional Defects Of Civil Law & Remedies in economic Law

With rapid development of Chinese economy,inequality between the subjects in the economic relations fades away and ownership is absolutely limited and contractual freedom becomes relative,therefor traditional role played by civil law becomes somewhat defected and it is imperative to make right the defect by way of economic laws.
