| 摘 要： | 我国的金融监管法中存在授予监管者的权力过于宽泛和原则化以及缺乏可操作性的弊端，必须通过完善相关立法来予以纠正。立法加强对监管者法律责任的规定，有助于落实监管者的处罚权，保障监管者权力的行使，还有利于金融监管的实践。通过对发达国家金融监管立法中关于监管者法律责任的规定和对监管者权力制约及监督机制的研究与分析，可以利于我们立法时对国际金融机构权力制约和监督机制加以比较借鉴。
