“更好规制”:规制治理的新理念与新追求

21世纪以来,“更好规制”成为市场经济发达国家规制改革的流行标签。通过规范规制决策的标准和程序改进政策制定和规制方式,减少政府规制行为的负面影响,提升规制质量,发达国家将“更好规制”作为推进行政体制改革、改善规制治理的新理念与新追求,以增加其行政合法性,并为经济发展营造良好的营商环境。厘清“更好规制”的兴起背景,阐明“更好规制”的理论内涵及主要工具,借鉴“更好规制”的合理之处,对推进我国规制改革具有重要意义。在推进国家治理现代化的进程中,建构与现代市场经济相适应的规制体制,必须转变规制观念,树立“更好规制”理念,改进规制方式,建立规制影响评估、规制协商和信息公开制度,促进规制工具的动态组合与优化,提高规制治理效率和规制质量。

“Better Regulation”:The New Idea and New Pursuit of Regulation Governance

Since the 21st century,“better regulation”has become a popular label of regulation reform in developed market economy countries.By standardizing the standards and procedures of regulatory decision-making to improve the way of policy-making and regulation,reduce the negative impact of government regulation behavior,and improve the quality of regulation,the developed countries take“better regulation”as a new way to promote the reform of administrative system and improve regulatory governance,so as to increase their administrative legality and create a good business environment for economic development.Clarifying the background of the rise of“better regulation”,the theoretical connotation and main tools,and drawing on the advantages of“better regulation”,are of great significance for promoting the regulatory reform in China.In order to build a regulatory system suitable for the modern market economy,China must change the concept of regulation,set up the concept of“better regulation”,constantly improve the way of regulation,establish the system of regulation impact assessment,regulation consultation and information disclosure,promote the dynamic combination and optimization of regulatory tools,and improve the efficiency and quality of regulation.
