| 摘 要： | 沉默权的取舍去留 ,学术界至今仍是众说不一。笔者从分析沉默权制度的合理性与缺陷出发 ,以当前我国犯罪率高、破案率低 ;主民观念、权利意识淡薄等法制现状为客观依据 ,拟提出相对合理的替代制度来实现沉默权制度在我国从无到有的过渡。
