大陆民营企业人岛投资法律环境探析

大陆民营企业入岛投资理论上具有较大优势,但实践进展缓慢,入岛投资的家数与金额都低于预期,理论与实践呈现出明显的反差。从法律环境的角度分析投资进展为有效方式。两岸涉及投资的法律逐步规范并处于趋同之中,具有良好的基本面。但法律环境也突显不足,最主要的原因是我国台湾地区对投资从指导思想到具体制度都有较强的行政审查色彩,遏制了民营企业的投资。未来法律环境的改善需两岸共同努力。

On Legal Environment about Mainland Private Enterprise Investment in Taiwan

Mainland private enterprise has huge theoretical superiorities of investing in Taiwan, but the practice shows slow progress in number of investment enterprises and amount of investment. Theory and practice demonstrate marked contrast. Using legal environment as analysis tool is effective. Investment-related law in CrossStrait is trending convergence, having good fundamentals. In fact, the legal environment highlights the insufficiencies. The biggest obstacle is Taiwan＇ s legal regime with obvious characteristics of administrative review, which curbs private enterprise investment. The improvement of legal environment calls for effort from the Mainland and Taiwan.
