尊重法律体系 引领法治发展——对宣布法律体系形成的得与失的考察

有中国特色的社会主义法律体系的形成,在中国法治建设过程中具有重要意义。但要想发挥法律体系的规范功能,就必须理性地对待它。现在法律体系面临着两个方面的夹击,一方面中国传统文化固有的轻视形式逻辑的实质思维倾向阻碍了规范功能的发挥。另一方面,在司法政策中过度强调社会效果、政治效果和能动司法的统一,使得法律的权威性难以树立,法治之路更加艰难。因而,强化形式法治的观念对我国法治建设有特别的意义,要想实现限权意义上的法治,必须充分发挥法律及其体系的规范作用。过早地批判、放弃形式法治将会使法律失信于民,成为法律白条;过多地讲政治、讲大局等是对政治资源的过度消费。

Respecting the Legal System and Leading the Development of Rule-of-Law —On the Gains and Losses of Declaring the Forming of Legal System with Chinese Characteristics

The socialist system of laws with Chinese characteristics is of important significance in the construction of rule-of-law. We should treat the legal system rationally so that it can play its ruling function. The legal system faces impacts from two sources. On the one hand, the substantial thinking of traditional Chinese culture which lacks formal logic hinders the function of ruling, on the other hand, laying undue stress on the unity of social effects, politics effects and the judicial activism weakens the authority of law. It is partieularly significant to strengthen the idea of formal rule of law to the construction of rule of law of China. Only when the law and the legal system play a ruling role, can we realize the rule of law of limiting powers. We will lose the trust of people if we criticize and give up formal rule of law too early. Excessive emphasis on the overall situation and the politics is excessive consumption of political resources.
