| 摘 要： | 我国现行刑法中，只对共同故意犯罪的刑事责任有规定，对出于共同过失的犯罪，我国刑法不视为共同犯罪予以处罚，但是，共同过失犯罪同共同故意犯罪一样，应属于共同犯罪的范畴。而在监督过失中，监督者与被监督者的过失行为，不属于共同过失犯罪。

| Abstract: | Criminal Law of our country provides: The joint intentional offense should bear criminal responsibility.The offense of Joint Negligence shall not be punished as a joint crime.But,the offense of joint negligence is as same as the joint intentional offense,it belongs to the joint crime.In the supervisory negligence,the negligent action between the supervisor and the person under his supervision should not be include in the offense of joint negligence. |
