| 摘 要： | 在民事、行政诉讼过程中 ,人民法院因作出错误判决且不能执行回转、在审理和执行案件中违法采取强制措施、财产保全措施或执行生效法律文书错误 ,给相对人造成损害的 ,国家应承担赔偿责任。
