| 摘 要： | 消费诉讼在我国 ,不是一种特别诉讼 ,也没有自身专门的制度体系 ,有关规则适用民事诉讼法的一般规定。然而 ,由于消费诉讼自身凸显的特性 ,适用一般民事诉讼规定已经明显不足 ,文章从分析我国消费诉讼现状入手 ,借鉴国外及我国港台地区消费诉讼 ,以探求建立我国消费诉讼制度

| Abstract: | There is no specific system in China for the consumption lawsuits. General provisions in Civil Procedure Law are adopted for application concerned. But this is not enough now according to the characteristics of consumption lawsuits. So the thesis analyzes the present situation of consumption lawsuit in China and seeks for the establishment of that in China. |
