摘    要:2003年杭州发生了中国首起有关电影贴片广告的消费者诉讼,通过对案件的分析,认为电影贴片广告本身并不违法,但目前的播放方式以剥夺知情权限制了消费者的自由选择权。同时对经营者应当承担何种法律责任进行了探讨。

Abstract:In 2003,the first lawsuit about cinema advertising in China was brought by a consumer in Hangzhou.This article,through the analysis on this case,raises the viewpoint that cinema advertising itself is not illegal.However,the current way for its broadcasting deprives the consumers right to learn the truth,and therefore place unreasonable restrictions on their freedom to select goods or services.Following the presentation and elaboration of this viewpoint,this article goes deep into this issue by the discussion on what kind of responsibility should be blamed on the cinema businessmen for illegal broadcasting.
