| 摘 要： | 对抗制和审问制之间并不存在孰优孰劣,都是现代法制国家在文明社会条件下发展的审判方式.不应简单否定审问制,也不应全盘照搬对抗制,而应在对两大法系的审判方式认真比较的基础上,对外国的有益经验兼收并蓄,创立符合社会主义法治原则的审判方式.

| Abstract: | We can't simply say which one is better or worse between inquisitorial system and accusatory system. These two systems are developed in the modern legal countries under the condition of civilized society. We shouldn't simply negate the inquisitorial system and fully introduce accusatory system. We should compare these two systems and assimilate advantages of them before we establish the trial system conforming to the socialist principle of "run by law". |
