浅议我国基层劳动监察

劳动监察作为一项劳动法律制度,负有保障劳动法体系全面实施的功能。随着我国社会主义市场经济的确立和完善,原来带有计划经济色彩的劳动监察制度已不适应当今形势的需要。由于我国劳动监察立法和执法的缺陷,导致在基层劳动监察执法的困难。因而,我国应强化劳动监察执法权力,完善执法程序;改革劳动监察管理体制,实行省以下垂直管理;着力完善劳动监控制度,以科学分类为基础,同时做好查处和服务;多途径招纳、培养人才,提高队伍素质;提高监察装备水平,加强应急能力建设。

An Analysis of Grass Roots Labor Supervise in China

As a part of labor law system,labor supervise has the function of guaranteeing the implement of the system.Along with the socialist market economy was set up in China,the old system of labor supervise with characters of planning economy can not meet with the need of new position.Since the limitation of legislation and enforcement,there are difficulties in grass roots labor supervise and it is not optimism.Therefore,China should intensify the enforcement power of labor supervise,perfect the enforcement procedure,reform the management system and realize uprightness management below province level,perfect labor supervise system through scientific classify and good investigation and dealing with,recruit and foster talents through varies ways to improve the quality of cadres,improve the supervise equipment and the ability to meet an emergency.
